United States District Court Southern District of Florida
Case Description
Christopher Moale versus Tonno Limited, et al. Case No. 1:19-cv-25114-MGC. The district court entered an Order Granting Defendant’s Motion to Dismiss ruling that the court lacked both General and Specific Jurisdiction over Tonno. Florida’s general jurisdiction statute allows the exercise of jurisdiction over “[a] defendant who is engaged in substantial and not isolated activity within this state.” Thus, for general jurisdiction determinations, a court need only address whether the exercise of jurisdiction would exceed constitutional bounds. Having concluded that Florida’s long-arm statute provides no basis for exercising jurisdiction over Tonno, the Court needed not address the second inquiry as to whether the exercise of jurisdiction comports with due process.
