Clear Spring Property and Casualty Company, et al versus Viking Power LLC Case No 0:23-cv-62306-CMA. The district court issued an order granting Motion for Summary Judgment in favor of the Plaintiffs. In its final judgment, the Southern District ruled that Viking Power violated the Policy’s fire-suppression warranty. As a consequence, Plaintiffs are not required to provide coverage to Defendant for the loss of the Miss Dunia and are not obligated to defend or indemnify against third-party claims arising from the loss.
